Truck driver class action representative wins his appeal.   This was an appeal heard in the Court of Appeal Second Appellate District Division 8 regarding a  Putative class action.  The  trial Court, Judge Joanne O’Donnell,  granted summary adjudication against the  Truck Driver  class representative stating that he was an independent contractor not an employee.   Held:  Reversed  and remanded for trial   with  directions to vacate order granting summary Judgment and enter a new judgment denying the motion.
